RESTRICTED ITEMS POLICY

Restricted Items Policy

All Quality Exchange Consignments™ (Q.E.C.™) and/or YardSalersAnonymous™ members using Q.E.C. Re-sales and/or Auctions are expected to understand and comply with all of the BANNED ITEM'S rules listed below.

Alcohol - The sale of alcohol in opened or unopened containers is not permitted. Other related memorabilia are permitted.

Animal products - Any item made of or containing animal product. This includes but is not limited to abalone, crocodile, elephant, leopard, mink, ostrich, rabbit, tortoise, turtle, whale, zebra and any kind of bone. The exception to this rule is for cowhide leather goods (purses, shoes, trunk with a leather strap, etc.), horsehair-stuffed items, and wool (sheep, alpaca, lama). Our exception to this policy is the resale of Indian items by documented and certified American Indian Artists. In all Indian craft genre, Q.E.C. promotes the artist and any disputes between buyer and seller ALWAYS gives the Indian crafts seller the rights. This means that the Indian crafts artist reserves the right to refuse to sell to you as an individual. This policy is solid. You should be aware of this policy before purchasing American Indian art.

  • The word "tortoise" - We are no longer allowing the use of the word “tortoise” to describe an item.
  • Ivory - Due to strict laws concerning the sale of ivory, we only allow sales of antique ivory (that is, ivory before year 1900) on our site. If we, Q.E.C. or our constituents or valued members determine that the Ivory item submitted is considered “new”, we reserve the right to immediately and without warning pull down the item from resale. We are not considered the seller of record for laws concerning the sale of ivory. You may still sell your item on our site as you are considered the seller of record in that venue but be warned that Q.E.C. does not guarantee that this policy will not change without warning to the seller.

Art - Replicas, copies, etc. must be marked as such in the title or description. Reproductions of copy-written artwork must display a copy of the original artist's authorization.

Autographs (ALL AUTOGRAPHS) - We currently do not have any way to determine whether the Certificate of Authenticity "COA" that is provided with each item is valid. Therefore, all autographed items must display our PERSONAL OPINION policy along with the name, address, and certificate number of authenticator. This allows the buyer to determine authenticity of the COA and gives the buyer complete control over buying item authentic or not.

Coins - Replicas, copies, etc. must be marked as such in the title or description.

Cosmetics - Used cosmetics are not permitted. If an item is unused, but opened, this must be stated on the item.

Clothing - Used clothing is permitted provided that the item has been cleaned before the item is shipped to the winning bidder. Used under garments are not permitted unless cutup for quilting, cleaning, or other such purposes.

Firearms, weapons and related items - This includes but is not limited to antique, toy, imitation, parts and accessories, Nunchuks, spears, billy clubs, knives, swords, etc.

Human - The sale of items containing human body parts, or any substance derived from the human body is not permitted.

Jewelry - Imitation, fake, simulated, lab created stones.
Listings are prohibited if the title or the description of the item contains the "name" of a stone, such as "diamond", "opal", "ruby", "pearl", etc., and that stone is an imitation, fake, simulated, lab created, etc., stone. Faux pearl, synthetic pearl, artificial pearl, simulated pearl, etc. are not permitted. If you must use the name of a stone in your listing, for example "topaz glass", you must state "topaz-colored glass".

* All Cartier items are now prohibited from our auctions due to a high number of trademark infringements with their trademarked style "tank".

Law enforcement items - The listing of law enforcement badges or official law enforcement equipment from any public entity, including badges issued by the government of any country is not permitted.

Mature items - Items that show any nudity or depict sexual acts are not permitted. For now, this also includes pieces of artwork that may be considered fine art-such as certain paintings, carvings, figurines and other similar materials. For fine art items, contact our support team at ysa@qualityexchangeconsignments.com to consign. We do not consign items of graphic vicious nature, naked explicit performance, or evil intent or content. Do not ask.

Medical Equipment - Medical devices and supplies must be clean and noted that the item has been used or opened if true. Items that are intended to send a current (shock the user) are not permitted.

Military items - Military items are permitted regardless of the war or period if item is authenticated or if wording says, “This is our personal opinion of this piece and the history as we know it. Please contract with a certified appraiser to set up an appointment to have this item appraised by a professional appraiser. We are not in the business of appraising products. Our knowledge is limited to a personal opinion of the authenticity.” This includes but is not limited to all memorabilia, awards/certificates, armor, clothing, photos, etc.

Motorized Vehicles - All motorized vehicles and certain vehicle parts are permitted (i.e., compressors) IF the seller gives name, address, and phone number. Q.E.C. is not a used car dealer. We allow you, the individual or car dealer, to sell items if you abide by our dealer notification or owner notification rules. Toys are permitted.

Native American items - This includes both "American Indian" or "Alaska Native" items that are authentic or reproduction. These items are allowed by the original artist or by documented Civilized Tribes number. We also permit items to be sold by certified sellers of authentic Tribe memorabilia as long as permit number is established, and seller has documented authority to sell items. We, at Q.E.C., are committed to the promotion of American Indian artistry and the ability of all Tribes to contribute to our American culture as they are the original inhabitants of this country. If you, the seller, or you, the buyer, have questions about an item, please contact us immediately. Q.E.C. always defers to the Tribal Council on Indian item sales. We value Tribal participation in our on-line promotion of American Indian culture. Please ask about our “free” space available for artist or Tribal promotion.

Offensive items - Items are not permitted which promote or glorify hatred, violence, racial or religious intolerance, or items that promote organizations with such views.

Pipes - The sale of pipes or any other smoking facilitator (papers, roach clips, etc.) or items containing tobacco are prohibited.

Political memorabilia - Political memorabilia is permitted, however, reproduction items must be marked as such in the item's description.

Stamp - Replicas, copies, etc. must be marked as such in the title or description.

Stocks and certificates - The sale of stock or other securities is not permitted. Old or collectible stock certificates, provided that such stock certificates are cancelled and/or represent an interest in an entity that no longer legally exists are permitted as long as this info is stated on the item.

Slot machines - The sale of slot machines, whether functional or not, is not permitted due to complexity in differing state laws.

Tobacco items - The sale of items containing any actual tobacco or other smokeable plant are not permitted. Tobacco-related collectibles are permitted.

Trademarks - Once a company who owns a trademark has filed a complaint against an item listed by Q.E.C., we are forced to take immediate action to ensure that the issue does not occur again. Due to repeated offenses by several different dealers, we no longer permit the sale of items made by: Chanel, Eberhard, Patek Phillippe, Tiffany (jewelry), Breitling, Alexander Calder.

Rolex and Kate Spade items may be sold; however, the maker's trademark must be displayed prominently on the item.

REMEMBER - You may not use a trademarked name anywhere on your item unless you are positive that the item was produced by the owner for the trademark. FAKES AND COPIES ARE NEVER PERMITTED!

RESTRICTED PAYMENT POLICIES:

1. Payment Surcharges - Sellers may not charge buyers an additional fee for their use of ordinary forms of payment, including acceptance of checks, money orders, electronic transfers or credit cards. Such costs should be built into the price of the item.

Examples of practices that are NOT permitted:

  • Charging an extra fee to use a credit card instead of a check.
  • Charging an extra fee to use PayPal©

A seller can add a surcharge to the final price of the item in the form of reasonable shipping and handling fee. A shipping and handling fee can cover the seller's reasonable costs for mailing, packaging and handling the item. Shipping and handling fees cannot be listed as a percentage of the final sale price.

2. PayPal policy - All payment methods offered via PayPal© must be accepted for AUCTION and/or Re-sales transactions (for US based transactions).

Sellers who offer PayPal© as a payment option (either using logos or text in the item description) must accept all forms of PayPal payment including account balance, bank account transfer, and credit cards. Sellers must have a Premier or Business PayPal Account or be willing to upgrade from a Personal PayPal Account to a Premier or Business Account if sellers receive a credit card payment. Sellers may not communicate to buyers that they accept, or will not accept, specific forms of PayPal payment.

The following statement IS permitted in your listings:

“I accept all forms of PayPal payment."

The following statements are NOT permitted in your listings:

  • “I accept PayPal but do not accept credit card payments through PayPal.”
  • “I only accept PayPal if the bid amount is greater than $15.”

3. Acceptable Payment Methods

  • PayPal
  • Credit cards including Mastercard/Visa /Amex/Discover and debit cards (When website shopping cart is established.)
  • Bank electronic payments, bank-to-bank transfers (aka bank wire transfers or bank cash transfers). Must clear bank within 10-14 days before sending item(s).
  • Sellers may accept COD (cash on delivery) or cash for in person transactions.
  • Payment through Comcheck (must be pre-approved)
  • Personal checks, money orders, cashier’s checks, certified checks and other negotiable instruments.

Any Payment Method NOT displayed above is NOT permitted including:

  • Sellers may not solicit buyers to mail cash.
  • Sellers may not ask buyers to send cash through instant cash transfer services (non-bank, point-to-point cash transfers) such as Western Union or Moneygram.
  • Sellers may not ask buyers to pay with Stormpay, Greenzap.com, BidPay or e-gold payments.

4. Q.E.C. members - Resale and Auctions Ecommerce Policies must be the same members
Q.E.C. members choosing to use Auctions and/or Re-sale venues must offer the same "Auction ecommerce policies" (that are permitted above) to buyers who purchase items on qualityexchangeconsignments.com or any of the other linked web sites. Safety and convenience are at the core of Quality Exchange Consignments’ policies toward payments. Our policies are designed to promote safe online shopping, and to encourage online payment methods that are safe, easy to use, reliable, and offer high levels of protection for users.

GENERAL LISTING POLICY:

1. Using any company's trademarked name in your item's listing
If you are unsure who the maker is for an item, you are NOT permitted to state that the item is like that of a branded or trademarked name (which are most company names).

Example NOT allowed: Karen bought a diamond ring from an estate sale. She does not know who made the ring, but the setting looks very similar to a Tiffany setting. Karen listed the item stating, "looks like it might be a Tiffany setting."

A clear photo of the trademark on the item is required.

2. Sellers are not permitted to make comparisons between items in a listing title (however you can do so in the description field)

Example NOT allowed:
The titles "Leather Handbag, like Chanel", "Leather Handbag, Chanel style", or "Leather handbag, not Chanel" are not permitted because they make comparisons between the appearance of the item being offered, a leather handbag, to a Chanel handbag.

Example allowed:
Alice sells shoes. In the description area of her listing for one of her best-selling types of shoes, she has made the statement "these shoes are very sturdy, like Doc Martens boots".
This is permitted because it compares an item's functionality to another similar product. Also, this info is displayed in the description of the item, not the title and the listing are not misleading in any way as to which company made the item offered. The company to whom the comparison is being made is NOT permitted to be listed in the title.

NOTICE: Both buyers and sellers: Items listed without authentication by certified and well-known authenticator, shall adhere to our PERSONAL OPINION policy. Whereby, the buyer is put on notice that the seller makes no guarantees of authenticity, but that the buyer may contract (paid completely by buyer) with a certified authenticator of buyer’s choice to schedule a viewing of item to authenticate and certify the item as authentic.

3. Keyword Spamming

keyword spamming that is not permitted:

a. Lists of words:
The inclusion of words as a means to attract viewers via searches that do not truly describe the actual item:

Example not allowed:
"oil reproductions, art recreations, gallery, art gallery, impressionist, impressionism, oil paintings, reproduction, painting, recreation, copy, quality, reproductions, recreations, realistic, copies, paintings, old masters, replica, posters, prints, video..."

b. The inclusion of words that are used to promote the seller’s other online listings.

Example not allowed:
"Please view my other listings on: www.websites.com"

Example allowed:
"Please view my other Q.E.C. listings."

4. Item Description and Picture Theft

Q.E.C. members are not allowed to use other members or user's pictures or descriptions in their listings or About Me pages without the owner's permission. This includes taking another user's image and editing it or using just a portion of another user's text for your listing.

5. Seller Contact Information and References to Other Websites

Q.E.C. does not permit any contact information (email address, phone number, etc.) or reference to other websites in text or photos. The exception to this policy is for motorized vehicles and parts of motorized vehicles that are considered “dealer” items. Websites other than Q.E.C. are prohibited. This includes but is not limited to other third-party sites and the seller’s own websites.

NOTICE: Q.E.C. and/or YardSalersAnonymous do not guarantee resale or auction of items. Some items do not sell, and the seller is responsible for payments to Q.E.C. and/or YardSalersAnonymous whether the item sells or not.
